Welcome to The Candy Co's Terms & Conditions. Throughout these Terms & Conditions and our Privacy Policy, we will refer to ourselves as "The Candy Co," "we," "us," or "our." The term "you," "your," or "yourself" represents any person using our website and/or registered to order goods from us.

By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following Terms and Conditions ("Terms and Conditions," "Terms"), including those additional Terms and Conditions and policies referenced herein and/or available by hyperlink. These Terms and Conditions apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

To purchase products from The Candy Co. website you must;

• Be 18 years of age or older

• Provide accurate and complete information during the registration process or when placing an order

• Be responsible for keeping your personal details up to date and informing us of any changes

• provide your real company name, address, phone number, email address, and any other information required to process your order

We reserve the right to decline a new customer or suspend a customer's use of our online store at our discretion. We may terminate your access to all or part of our services with or without notice and discontinue all or part of our website with or without notice.

It is your responsibility to review the most current version of the Terms and Conditions before using our website or placing an order. By continuing to use our website or placing subsequent orders, you are agreeing to be bound by the updated Terms and Conditions. If you do not agree with any of the revised Terms and Conditions, please refrain from using our website or placing an order.

AVAILABILITY

In the event that we are unable to supply a particular item for reasons beyond our control, we will not be held liable. We will, however, make every effort to provide substitute products in case of unavailability, unless you indicate otherwise. If you have already paid for the product(s), a full refund will be issued. For orders of large quantities of an item, we may need to check availability and stock levels before confirming the order.

Please note that the fulfilment of orders for our wholesale customers is subject to different procedures and warehouse storage methods, and therefore the discretion of the warehouse does not apply to these orders.

PRICING

The price of a product displayed on our website at the time of placing the order (plus any applicable delivery charges) will be charged. While we make every effort to ensure that all prices listed on the website are accurate, it is possible that errors may occur. If the correct price of a product is higher than the price listed on the website, we reserve the right to refuse or cancel the order. In such cases, we will notify you as soon as possible and give you the option to confirm the order at the correct price or cancel it. If we are unable to contact you, the order will be cancelled.
 

Please note that the prices listed on the website are only representative of the products sold online and may differ from our cash and carry pricing. All prices are shown in Nigerian Naira (NGN) and, where applicable, VAT will be charged during the order confirmation and checkout process.

PRODUCT DESCRIPTION AND INFORMATION

We take great care to ensure that all prices, details, descriptions, and product information on our website are accurate and up to date. However, please note that the information appearing on the website at any given time may not reflect the exact information at the time of placing the order.

Please be aware that the appearance and colours of our products may vary slightly from the appearance shown on the website. We cannot guarantee that the product delivered will exactly match its appearance on your monitor. All sizes, measurements, and dimensions are approximate, and every effort has been taken to ensure their accuracy.

PLACING AN ORDER AND ACCEPTANCE
When you place an order, you are making an offer to buy products from us. We reserve the right to decline your order or the supply of goods at any time before the order is dispatched. The contract between us will only be formed once we dispatch the order. Please note that the order acknowledgement email and order number do not confirm the order or constitute an acceptance from us. In cases where items are dispatched separately, our acceptance of the order will take place for each item at the time of dispatch.

PAYMENT
We operate on a pro-forma basis for all orders, unless stated otherwise. Upon checkout, an order confirmation will be generated for both you and us. We will verify the order and generate a pro-forma to show the products that will be dispatched. Please note that the pro-forma may differ from the order confirmation if any products are unavailable.
 

Once payment is made via Bank Transfer, or debit/credit card, we will issue an invoice for your purchase. When paying by card, we will use a third-party database to validate the name, address, and other personal information you provide to ensure that the card is not being used without your consent. By agreeing to our terms and conditions, you consent to such checks being carried out.
 

Please be aware that all products ordered remain the property of The Candy Co. until full payment has been received.

DELIVERY

We use GIG logistics to deliver all shipments within the Nigeria, depending on the size of the order and the delivery address. The delivery will be made to the address that was provided when the order was placed. Please ensure that a responsible adult of 18 years or over is available at the time of delivery to check and sign for the goods. If no one is available, we reserve the right to have the shipment returned to us, and you will be responsible for any missed delivery charges and any further delivery costs incurred.

We aim to dispatch orders within 24 hours, but in some cases, it may take longer. Delivery charges will be calculated after order confirmation to ensure the lowest possible cost from our haulage partners. Delivery dates and times will be arranged between you and the haulage company, and we will not be held responsible for missed, cancelled or delayed deliveries.
 

If you collect from our store, no delivery charge will apply, and we will agree on a collection time with you.
 

Orders are typically delivered within 2-3 days of placing an order, but unforeseen circumstances may cause delays. Same Day and Next day delivery may be possible for orders placed before the specified time on our website, subject to availability and confirmation of shipping charges. We may also offer reduced or free delivery options during promotional periods.
 

For international delivery, we will work with the haulage company and the destination country to arrange shipping terms. We take great care to ensure timely delivery, but we cannot be held liable for any delays that are out of our control.

RETURNS, REFUNDS, CANCELLATIONS AND DAMAGED OR INCORRECT GOODS

You have the option to cancel your order if you change your mind, but you must do so before we dispatch the order. Please be aware that you are responsible for canceling the order until we have been informed. We strive to ensure that all our products arrive in excellent condition. However, if you need to return some or all of your non-perishable items for any reason, we are happy to refund or replace them. Unfortunately, perishable goods cannot be returned or replaced due to their shorter lifespan.
 

If you want to return any part of your order because of shortages, damages, or errors, please contact us by email or phone within 24 hours of receiving the shipment. Please take photos of any damaged items and note the issue on the delivery slip. We will make the necessary arrangements to have the goods returned to us and issue a refund or replacement after inspecting them. If applicable, the refund will be made using the same payment method that was used to purchase the items.
 

Please note that we will not be liable for any further claims for loss arising from or in conjunction with the supply of unsatisfactory goods, whether direct, indirect, consequential, or otherwise. Our returns policy does not affect your statutory rights.
 

Please be aware that we are unable to refund gift cards.

SPECIAL OFFERS AND PROMOTIONS
Occasionally, we may provide special promotions and offers on our website. These offers are subject to availability and while stocks last, and are also subject to the instructions of the offer which are included as part of the Terms and Conditions. Please note that all offers are subject to change or removal at any time, without prior notice. However, any orders placed before the offer is removed or altered will be honoured. We reserve the right to change offers based on customer demand and market sectors.

WARRANTY & LIABILITIES

Although we take great care in delivering your order, we cannot be held liable for any indirect or consequential losses, damages, or loss of profits arising from our supply or failure to supply any goods to you. We will not be held responsible for any breach of these Terms and Conditions resulting from circumstances beyond our control, including any delay or failure to perform our obligations if caused by any cause or circumstance beyond our reasonable control. Our liability to you in connection with any order will be limited to the total price charged for the relevant goods and delivery charges in that order.
 

You are not allowed to assign, sublicense, or transfer any of your rights under these Terms and Conditions. However, nothing in these Terms and Conditions will limit our liability to you for death or personal injury resulting from our negligence, breach of contract, or breach of statutory duty. Our returns policy does not affect your statutory rights.

We may include links to other websites, but we have no control over the content found on those sites. Therefore, we cannot be held liable for any information or content found on those third-party sites. Please note that these links are provided solely for your convenience, and you access them at your own risk.

WEBSITE AVAILABILITY & IMAGES
We make every effort to ensure that the website is available 24/7, but we cannot be held responsible if it becomes unavailable for any reason, at any time.

At any given time the product images on the website may be different to the current product packaging. This may be due to changes in the packaging, the price mark or other aspects of the packaging, which are out of our hands. We will do our best to change the images where necessary, but will not be held liable for any reason where this has not been achieved.

 

GENERAL

If any provision in these Terms and Conditions is deemed invalid by a court with competent jurisdiction, it will not affect the validity of the remaining provisions, which will remain in full force and effect. If you violate these Terms and Conditions and we do not take any action, we are still entitled to enforce our rights and remedies in the future or in any other situation where you breach these Terms and Conditions.
 

A person who is not a party to these Terms and Conditions has no right to enforce any term of these Terms and Conditions under the Contract (Rights of Third Parties) Act 1999. However, this does not affect any right or remedy of a third party that exists or is available apart from that Act.
